Anti-Hawking

This page explains how iQuotes approaches anti-hawking obligations in connection with the iQuotes platform.

iQuotes is an online platform that offers a secure way to receive competitive insurance quotes from Australia’s leading specialist insurance brokers.

We are committed to helping ensure that contact made through the platform is based on the user’s request and is limited to the insurance category selected by that user.

What anti-hawking means

Anti-hawking laws are designed to restrict the unsolicited offering, requesting or arranging of financial products in real-time conversations in circumstances where the consumer has not requested that contact or discussion.

These rules are intended to protect consumers from being pressured into discussing or acquiring financial products they did not ask about.

How iQuotes works

iQuotes allows a user to submit an enquiry for a specific insurance category through an online form on our website.

When a user submits that form, the user is actively requesting contact about the selected insurance category. The user provides their contact details and enquiry information for the purpose of being contacted in relation to that selected category.

Once submitted, the lead may be distributed to brokers who specialise in that insurance category. Leads are distributed using a fair round-robin methodology.

Scope of consent and requested contact

By submitting an enquiry through iQuotes, the user is requesting to be contacted in relation to the specific insurance category selected in the form.

That request for contact applies only to that selected insurance category. It is not intended to be treated as consent to unsolicited contact about unrelated products or services.

Contact may be made by us, or by brokers who receive the enquiry, using the contact details provided by the user, including phone, email or other contact information submitted through the form.

What users should expect after submitting a form

If you submit an enquiry through iQuotes, you should expect that:

  • your information may be shared with brokers relevant to the selected insurance category;
  • we and/or those brokers may contact you using the details you provided;
  • that contact will be for the purpose of responding to your request about the selected insurance category; and
  • the brokers may receive the full information you submitted so they can assess and respond to your enquiry.

Our platform approach

We structure our forms and lead distribution process so that enquiries are tied to a user-selected insurance category. Our intention is that contact made through the platform is connected to that requested category and is based on the user’s initiated enquiry.

We do not intend for the iQuotes platform to be used to support unsolicited offers or discussions about unrelated financial products that the user did not request through the form.

Expectations for participating brokers

Brokers who receive leads through iQuotes are expected to use the enquiry information for the purpose of responding to the user’s request regarding the selected insurance category.

Participating brokers are responsible for ensuring that their own conduct, communications, advice, offers, dealing and disclosure practices comply with all applicable laws and regulatory obligations, including any anti-hawking requirements that apply to them.

No legal advice

This page provides a general overview of how the iQuotes platform is intended to operate. It is not legal advice and should not be relied on as legal or regulatory advice by consumers, brokers or other users of the platform.

Brokers should obtain their own legal or compliance advice about how anti-hawking laws and other financial services obligations apply to their business and communications.
